The state courts' Small Claims Manual says either side must give at least 30 days' notice to end a month-to-month lease, unless the lease says otherwise.

Statewide rent limits

Preempted7,8Ind. Code 32-31-1-20

Cities, towns and counties may not regulate rents on private housing unless state law allows it. Housing that receives government help to offer lower rents is excluded.

Landlord entry

Reasonable notice9,10,3Ind. Code 32-31-5-6(g)(2)

The landlord must give reasonable written or oral notice before entering and may enter only at reasonable times. No notice is needed in an emergency that threatens the occupants or the property.

Notice for unpaid rent

10 days11,12,13,3Ind. Code 32-31-1-6, 32-31-1-8

If rent is not paid when due, the landlord may end the lease with at least 10 days' notice, unless the tenant pays in full in that time or the lease says otherwise. If the lease expressly requires rent in advance and the tenant does not pay, the law does not require notice.

Many cities and counties add their own rules, such as rent stabilization or longer notice periods, and a lease can give a tenant more protection than the law requires. Check your local housing office or a legal aid group before you act.
